By accessing or using ThemeXtra ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all visitors, users, and customers who access or use ThemeXtra.

/ 02 Description of Service

ThemeXtra offers digital products — primarily Bootstrap-based website themes for various industries. We deliver these as downloadable files after successful payment.

The Service includes:

• Browsing and previewing themes.
• Purchasing themes under specified license tiers.
• Downloading purchased themes and accessing license keys.
• Receiving updates and support per your license tier.

/ 03 Account Responsibilities

When you create an account, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password.
• Promptly notify us of unauthorized account access.
• Be responsible for all activities under your account.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.

/ 04 Purchases & Payment

• All prices are displayed in USD unless otherwise noted.
• Payment is processed by third-party providers (Stripe, Iyzico). We do not store full card details.
• Applicable taxes (VAT, GST) are added at checkout based on your location.
• You are responsible for ensuring your payment method is valid and authorized.
• License delivery occurs immediately after successful payment via email and your account dashboard.

/ 05 Intellectual Property

All themes, designs, code, branding, and content on ThemeXtra are owned by us or our licensors and protected by international copyright laws.

Your purchase grants you a license to use the theme according to the terms outlined in our License. You do not acquire ownership of the underlying intellectual property.

/ 06 User Conduct

You agree NOT to:

• Resell, sublicense, or redistribute our themes as standalone products.
• Upload our themes to template marketplaces.
• Use the Service for any illegal, fraudulent, or harmful activity.
• Attempt to gain unauthorized access to our systems.
• Reverse engineer or attempt to extract source code beyond what is provided.
• Interfere with the Service's normal operation (DDoS, bots, scraping).
• Impersonate any person or entity.

/ 07 Warranty Disclaimer

The Service and our themes are provided "as is" and "as available", without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted, secure, or error-free.
• The themes will meet your specific requirements.
• The themes will be compatible with all browsers, devices, or third-party tools.
• Any errors will be corrected.

/ 08 Limitation of Liability

To the maximum extent permitted by law, ThemeXtra and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months prior to the claim.

/ 09 Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms are governed by the laws of the jurisdiction in which ThemeXtra is registered, without regard to its conflict of law provisions.

Any disputes will be resolved through binding arbitration or in the courts of that jurisdiction.
