Buyer: the natural or legal person whose name, e-mail address and billing details are provided electronically at checkout. The information declared in the order form is taken as the basis of this Agreement.
/ 02 Definitions
- Site: the digital product marketplace operating at https://themextra.com.
- Product: intangible digital goods sold on the Site (HTML website themes) and the usage licenses attached to them.
- License: the Solo, Studio or Pro license packages, or the monthly Agency subscription, as described in the License Terms.
- Law: Turkish Law No. 6502 on Consumer Protection.
- Regulation: the Turkish Distance Contracts Regulation.
/ 03 Subject
This Agreement sets out the rights and obligations of the parties, pursuant to the Law and the Regulation, regarding the sale, licensing and electronic delivery of the digital Product that the Buyer orders electronically on the Site, whose characteristics and total sales price are stated on the order page.
/ 04 Product & License
The essential characteristics of the Product, the selected license tier and the total price including all taxes are as displayed on the product and checkout pages at the time of ordering. Announced prices remain valid until they are updated or changed.
- Solo, Studio, Pro: one-time license purchases with different usage scopes.
- Agency: a monthly subscription giving access to the full theme catalog while active.
The detailed scope and limits of each license are set out in the License Terms, which form an integral part of this Agreement.
/ 05 Payment
- Payment is collected in a single transaction by credit or debit card, in USD or EUR, through the Seller's bank virtual POS. Every payment is verified with 3D Secure; non-3D transactions are not accepted.
- Card details are entered on the bank's secure payment page and are never viewed or stored by the Seller.
- For the Agency subscription, the fee is charged in monthly periods until the Buyer cancels.
- A legally compliant e-Archive invoice is issued for every purchase and delivered electronically.
/ 06 Delivery (Performance)
The Product is an intangible digital good and is not subject to physical shipment. Upon payment approval, the Product is instantly assigned to the Buyer's account on the Site and becomes available for download. No shipping or delivery fee applies. Details are set out in the Delivery Policy.
/ 07 Right of Withdrawal
Pursuant to Article 15/1-(ğ) of the Regulation, the statutory right of withdrawal cannot be exercised for services performed instantly in electronic media or for intangible goods delivered to the consumer instantly. For consumers in the EU, a corresponding exception applies under Article 16(m) of Directive 2011/83/EU once performance has begun with the consumer's express consent.
Products sold on the Site are intangible goods delivered instantly upon payment approval. By confirming the order, the Buyer acknowledges that performance begins immediately, expressly consents to instant delivery, and acknowledges losing the statutory right of withdrawal.
Independently of the above, ThemeXtra voluntarily offers a 14-day money-back guarantee under the conditions set out in the Refund Policy. Cases such as duplicate charges or failed delivery are also handled under that policy.
/ 08 Force Majeure
Neither party is liable for failure to perform its obligations due to events beyond its reasonable control, including natural disasters, war, changes in legislation, infrastructure or internet failures, or power outages.
/ 09 Disputes
This Agreement is governed by the laws of the Republic of Türkiye. Consumers in Türkiye may apply to the Consumer Arbitration Committees at their place of residence or where the Seller is located, within the monetary limits announced annually by the Ministry of Trade, and to the Consumer Courts above those limits. Mandatory consumer rights granted by the laws of the Buyer's country of residence remain unaffected.
/ 10 Entry into Force
By completing payment for an order placed on the Site, the Buyer accepts all terms of this Agreement together with the Pre-Information Form. The Agreement enters into force on the date the order is confirmed electronically.
